Job Description/Requirements

he County Assembly of Turkana is one of the forty-seven (47) County Assemblies in Kenya established under Article 176 (1) of the Constitution of Kenya. Section 4 of the County Assembly Service Act, 2017 establishes County Assembly service Board which is an institution of exemplary administrative and technical competence further, Section 11(1) (b) mandates the Board to determine and review the terms and conditions of service of persons holding or acting in the offices of the Service.

Pursuant to this objective, the County Assembly Service Board is seeking to recruit highly motivated, visionary, dynamic and results oriented candidates to fill various positions:

1. Principal Legal Counsel- (CASB 05) REF: CAT/CASB/2021/001 (1 Positions)

Position Scope;

Reporting to the Director for Legislative Services, the successful candidate will be responsible for managing litigation, contract preparation and providing legal advisory on compliance in all organization's operations and advice on appropriate course of action.

Key Responsibilities:
I. Reviewing progress of outstanding litigation and liaising with and managing external lawyers;
II. Drafting of amendments to Bills to be proposed to the House by any Member of County assembly or any Committee of County Assembly.
III. Undertaking legal research on matters before the County Assembly.
IV. Liaising with the Office of the Attorney General on litigation matters involving County Assembly
V. Liaising with the Office of the County Attorney on Legislative work between the County Assembly and the County Executive.
VI. Scrutiny of legislative proposals emanating from the County Executive.
VII. Formulating compliance check-lists to be used for the purpose of ensuring that all information required is provided accordingly;
VIII. Maintaining records of contracts, leases, loan agreements and the covenants therein;
IX. Providing timely information on renewals or termination of agreements;
X. Drawing up contracts, lease documents, loan agreements and other legal documents;
XI. Liaising with relevant departments to ensure that where legal risks have been identified, appropriate courses of action have been taken;
XII. Providing legal risk management and advising management on contract processes;
XIII. Providing and interpreting legal information, conducting training and disseminating appropriate legal requirements to staff;
XIV. Preparing, reviewing and modifying contractual instruments to assist and support various business activities;
XV. Negotiating, reviewing and drafting documentation for business transactions and advising on the necessary checklist to be adopted to ensure information is submitted on time;
XVI. Ensuring the undertaking of due diligence searches on behalf of the County Assembly of Turkana, and liaising with external legal counsel as required;
XVII. Ensuring the follow up of all court cases facing the County Assembly of Turkana and attending court hearings where necessary, follow up of Judgements and costs on behalf of the County Assembly of
XVIII. Ensure compliance with statutory and regulatory requirements and represent the interests of the County Assembly of Turkana in legislative fora.
XIX. Assist in developing effective working relationships with external counsel and internal stakeholders to ensure their needs are understood and appropriate solutions developed that support business
XX. Performing any other duties as may be assigned from time to time.

Qualifications/Skills/Experience The ideal candidate must possess the following qualifications and competencies: –
• A Bachelor of Laws degree from a recognized institution;
 • An advocate of the High Court;
• Member of Law Society of Kenya with a current practicing certificate;
• A minimum of seven (5) years relevant experience;
• Should have thorough knowledge of the relevant industry/sector as well as knowledge; of regulatory requirements affecting the relevant sector;
• Must have ability to plan, organize, implement and evaluate assigned goals;
• Meet the requirements of Chapter six of the Constitution of Kenya, 2010.
 • Must demonstrate ability to handle multiple and conflicting priorities, and work under strict deadlines;
• High levels of integrity and confidentiality;
• Excellent leadership skills and negotiation skills;
• Strong analytical and organizational skills;
• Excellent networking, interpersonal and communication skills.
