Gad O. Ouma: The Litigation Rising Star & Face of Legal Disruption in Kenya
Gad Ouma is a living proof that young lawyers can succeed in law firm leadership even where senior lawyers fail by constantly innovating their legal practice, maintaining a reputation of excellence and offering visionary leadership that balances the professional and business competing interest of law. Barely 2 years since establishing G.M. Gamma Advocates LLP, Gad has built the firm into one of Kenya's leading medium size boutique law firm with over 10 lawyers, convinced a leading international law network (World Law Alliance) to admit the law firm into its network, won the confidence of many established local corporate and multinational clients to trust him with mouth-watering briefs, provoked countless commentary in national business press and became the face of disruption of legal sector in Kenya.
Started in July 2019, G.M. Mamma Advocates LLP has blossomed under Gad's leadership into a truly medium sized boutique law firm in so short a time. By the end of the firm year, the firm had established a presence in Nairobi City and Mombasa City and attracted dozens of top clients with its excellent offering of legal, advisory and training services in all areas of laws. The firm has since doubled its partner headcount and tripled its fee earners numbers and now has a team of 10 competent lawyers and 9 support staff all equipped and committed to meet the needs of its clients' needs effectively and with utmost professionalism, detail and confidentiality.
In the realm of legal practice, Gad is acknowledged by peers and clients as one of Kenya's leading corporate and commercial lawyers with experience advising, representing and acting for clients in Litigation and Dispute Resolution, Energy Law and Commercial law. He is a leading name in commercial litigation circles with a repertoire of complex and precedent-setting matters successfully handled in the areas of Arbitration, Constitutional and Administrative law, Maritime Law, Procurement Law, Finance and Investment, Contract law, Corporate law, Employment and Labour law and Taxation law.
Gad's clients at G.M. Gamma Advocates LLP include established and well-known local, regional and multinational institutions in both private and public sectors including listed and unlisted companies, major banks, SACCOs, telecom players, transport and shipping companies, utilities, power distributors and generators, prominent contractors, pension schemes, state corporations, government ministries, county governments, county assemblies, and other private institutions in complex high net worth matters.
Highlights of Gad's Litigation Prowess
The highlights of Gad's prowess in commercial litigation was his successful representation of Kenya's giant power utility in what has been aptly described as the region's first multi-billion-dollar public interest class action which attracted a lot of media attention and headlines. Gad was successfully resolved the case which was seen by many analysts as a 'bet-the-company" case for the leading utility company and having the potential to cause a national energy crisis with no award as to costs against the client.
Recently, Gad successfully acted for a leading bank in a commercial transaction relating to creation and discharge of securities in the sum of KSh. 700 Million. He also represented the Boards of a leading parastatal in the Communication Sector and a regulatory body in the Transport and Shipping Sector in matters that sought to restrain their ongoing recruitment of Chief Executive Officers. In both cases, Gad was able to convince superior courts to throw out the claims on time and allow his clients to proceed with the appointments.
Gad also represented a private transport and logistics company in a one-of-a-kind Petition challenging a public roads authority's exercise of statutory power to levy fines and penalties against alleged errant users of the National roads and highways. He succeeded in obtaining a favourable judgment for his client in which the statutory powers of the authority were found to be unconstitutional and the levy of the impugned fines and penalties was nullified in favour of the client and the entire industry.
Gad was also part of a defense team that successfully represented a leading power utility in a claim for breach of contract for cancellation of a supply contract for specialist goods where the subject matter was worth KSh. 4.7 Billion. He also represented a leading power generating firm in Court in a dispute over breach of construction of power plants contract worth KSh. 3.2 Billion which was successfully settled in favour of his client.
In addition, Gad was key member of a team that provided legal advisory services to a leading electricity generating company in East Africa in a Wellheads Geothermal Power Generation project valued at USD $41 Million. He also acted as the Lead Counsel of a Team of lawyers who carried out a comprehensive legal audit of a power utility with a regional presence in the Eastern Africa and market capitalization of USD 3 Billion.

He earned three distinguished academic awards in the course of his studies for Postgraduate Diploma in Law at the Kenya School of Law. He has attended many specialist professional courses and trainings on commercial law to perfect his skills and practice and is a certified Legal Auditor, Data Governance expert and Arbitrator. He is a member of Law Society of Kenya, East African Law Society and Chartered Institute of Arbitrators.
Gad Ouma and his firm G.M. Gamma Advocates LLP are legal eagles on the move. The firm is in the process of acquiring an ISO 9001:2015 certification on Quality Management Systems, a first in the legal industry, and proof of its commitment to offering high quality legal services to its clients. Indeed, if the firm's 4-year strategic plan 2019 to 2023 is any indication, G.M. Gamma is a legal player to watch. In any case, at the speed Gad Ouma (a fan of far cars) is driving the firm, it will soon outpace even century old law firms in its quest to explore unchartered legal territory.
